By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Eligibility

3. Account Registration

Business and enterprise users may create organization accounts with multiple team members. The organization owner is responsible for all activities under the organization account and managing team member access.

• Multi-platform simultaneous streaming
• Stream management and scheduling
• Recording and VOD storage
• Analytics and insights
• Integration with third-party platforms (YouTube, Facebook, LinkedIn, Twitch, TikTok)
• Team collaboration features

5. Acceptable Use Policy

5.1 Permitted Use

You may use our Platform for lawful purposes in accordance with these Terms. You agree not to use the Platform:

• To violate any applicable laws or regulations
• To infringe on intellectual property rights
• To transmit harmful, offensive, or illegal content
• To harass, threaten, or harm others
• To distribute spam or malware
• To interfere with or disrupt the Platform
• To attempt unauthorized access to systems
• To impersonate others or misrepresent your identity

5.2 Content Restrictions

You may not stream or upload content that contains:

• Illegal or criminal activity
• Hate speech, violence, or graphic content
• Sexually explicit material
• Copyrighted material without authorization
• False or misleading information
• Private information of others without consent

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of all content you create and stream through our Platform. By using our services, you grant us a worldwide, non-exclusive, royalty-free license to:

• Host, store, and transmit your content
• Process and transcode streams
• Distribute content to your selected destinations
• Create backups and recordings as per your settings

6.2 Our Intellectual Property

The Platform and its content (excluding your content), features, and functionality are owned by StreamFlowX and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer our Platform without written permission.

7. Third-Party Platforms

Our Platform integrates with third-party services (YouTube, Facebook, LinkedIn, etc.). You acknowledge that:

• You must comply with each platform's terms of service
• We are not responsible for third-party platform actions
• Third-party platforms may change or discontinue their APIs
• You are responsible for obtaining necessary permissions
• We store OAuth credentials securely but are not liable for third-party breaches

8. Subscription and Payments

8.1 Subscription Plans

We offer various subscription plans with different features and limits. Subscription fees are billed in advance on a monthly or annual basis. You agree to pay all fees associated with your subscription.

8.2 Payment Processing

Payments are processed through third-party payment processors (Stripe, PayPal, M-Pesa). You agree to provide accurate payment information and authorize us to charge your payment method.

8.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months or unused service, except as required by law.

9. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We may:

• Experience downtime or technical issues

• Suspend accounts that violate these Terms

We will provide reasonable notice for planned maintenance when possible.

11. Disclaimers

We do not warrant that:

• Defects will be corrected
• The Platform is free of viruses or harmful components
• Your content will not be lost or corrupted

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMFLOWX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

Our total liability to you for all claims arising from your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless StreamFlowX and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the Platform
• Your content
• Your violation of these Terms
• Your violation of any rights of third parties

14. Termination

We may terminate or suspend your account immediately, without notice, for:

• Violation of these Terms
• Illegal activity
• Non-payment of fees
• Fraudulent or abusive behavior

Upon termination, your right to use the Platform ceases immediately. You may download your content before termination, after which we may delete your data.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@streamflowx.com to attempt informal resolution.

15.2 Arbitration

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class actions.
